If you are agreeing to follow these Terms of Service on behalf of a legal entity other than yourself as an individual, including but not limited to a business or government entity, you represent and warrant that you have full legal authority to bind such entity to these Terms of Service.

By agreeing to use the Services, you agree to be bound by the Binding Arbitration Clause and Class Action Waiver described in Section 22 of these Terms.

4. Cancellation and Termination

Upon termination, we may permanently delete your account and associated data.

You may cancel your subscription at any time by:

Using the cancellation option available in your account dashboard.

Cancellation takes effect immediately, but you remain responsible for charges already incurred.

4.3 Suspension or Termination

We reserve the right to terminate or suspend access to Services at our sole discretion.

Immediately following the initial transaction, you authorize a recurring monthly subscription charge of $30.00 per month unless canceled.

7. Trial and Subscription Terms

Your initial payment grants access to the Services.

After the initial $10 payment, your subscription automatically converts into a recurring monthly membership billed at $30 every month unless canceled.

You may cancel at any time before the next billing cycle to avoid future charges.

8. Indemnification

You agree to indemnify and hold harmless America VIN, its owners, affiliates, employees, contractors, licensors, and partners from any claims, damages, losses, liabilities, or expenses arising from your use of the Services.

9. Recurring Subscription Authorization

BY PURCHASING SERVICES, YOU AUTHORIZE AMERICA VIN TO CHARGE YOUR PAYMENT METHOD:

AN INITIAL CHARGE OF $10.00;
FOLLOWED BY A RECURRING MONTHLY CHARGE OF $30.00 UNTIL CANCELED.

Refunds are not provided for partially used subscription periods.

11. Grant of Rights

Subject to compliance with these Terms, America VIN grants you a limited, revocable, non-transferable license to access and use the Services for personal, non-commercial purposes only.

12. FCRA Notice

America VIN is not a Consumer Reporting Agency as defined by the Fair Credit Reporting Act (“FCRA”).

The information provided through the Services may not be used for:

Employment screening;
Tenant screening;
Credit eligibility;
Insurance underwriting;
Any purpose governed by the FCRA.
13. DPPA Notice

You agree that motor vehicle records accessed through the Services will only be used for lawful purposes permitted under the Driver’s Privacy Protection Act (“DPPA”).

Improper use may subject you to civil and criminal penalties.

14. Restrictions on Use

You agree not to:

Use the Services unlawfully;
Scrape or harvest data;
Use bots or automated systems;

Use the Services to create competing products;

17. No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL SERVICES ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

18. Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL AMERICA VIN OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

OUR TOTAL LIABILITY SHALL NOT EXCEED $500 USD.

19. Security

While we use commercially reasonable safeguards, no internet transmission or storage system is completely secure.

You use the Services at your own risk.

20. Liquidated Damages

Improper disclosure or misuse of records obtained through the Services may result in liquidated damages of $100 per improperly disclosed record.

21. Arbitration Clause and Class Action Waiver

Any disputes arising from these Terms shall be resolved through binding individual arbitration and not through court proceedings or class actions.

You waive the right to participate in class-action lawsuits or jury trials.

22. Governing Law

These Terms are governed by the laws of the United States and applicable state laws without regard to conflict of law principles.
